Welcome to Privacy Labs. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Privacy Labs ("Privacy Labs", "we", "us", or "our"), governing your access to and use of our website, platform, products, services, and related applications (collectively, the "Services").
By accessing, browsing, registering, or using any part of the Services, you agree that you have read, understood, and are bound by these Terms, along with our Privacy Policy, which is incorporated herein by reference.

You are solely responsible for creating backup copies of your User Content. Privacy Labs is not liable for any loss of User Content.
You agree to use the Services solely for lawful purposes and in compliance with these Terms and all applicable laws. You must not:

All data processing is conducted in accordance with the Digital Personal Data Protection Act, 2025 (DPDP Act).
For Customers using our platform: You remain the Data Fiduciary for your end-users' data. Privacy Labs acts as a Data Processor and handles such data strictly in accordance with your instructions and applicable data protection agreements.
Customer Responsibilities:
Access to certain features of the Services may be subject to payment of fees. All fees are payable in the currency and on the terms specified at the time of purchase.
Privacy Labs reserves the right to suspend access if payment is not received on time.
All rights, title, and interest in and to the Services, including all software, technology, algorithms, content, visual interfaces, trademarks, logos, and documentation, are and shall remain the exclusive property of Privacy Labs.
You are granted only a limited right to access and use the Services in accordance with these Terms. No part of the Services may be copied, reproduced, distributed, or exploited without our prior written consent.
You retain all ownership rights in your User Content.
Each party agrees to maintain the confidentiality of all non-public, proprietary, or sensitive information disclosed by the other party. This includes source code, algorithms, trade secrets, technical data, business strategies, and customer data.
Confidentiality obligations do not apply to information that:
The Services are provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by law, Privacy Labs disclaims all express, implied, statutory, or other warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Privacy Labs does not warrant that the Services will be uninterrupted, timely, secure, or error-free.
To the maximum extent permitted by applicable law, Privacy Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of business opportunities, business interruption, or reputational harm.
Our total liability shall not exceed the amount paid by you for the Services during the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Privacy Labs, its affiliates, officers, directors, employees, and agents from any claims, liabilities, losses, damages, costs, and expenses arising out of or related to:
These Terms remain in effect for as long as you access or use the Services. You may terminate your use at any time by following the account termination instructions or by contacting us at dpo@theprivacylabs.com.
Privacy Labs reserves the right to suspend or terminate your access without notice if you violate these Terms or applicable laws.
Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination (including confidentiality, intellectual property, disclaimers, and limitation of liability) shall remain in effect.
These Terms shall be governed by and construed in accordance with the laws of India. In the event of any dispute, the parties agree to first attempt to resolve the matter amicably through good-faith negotiations.
If the parties are unable to reach a resolution within thirty (30) days, the dispute shall be submitted to the courts of competent jurisdiction in India.
